No way I'm going to prospectively tell you what to do and clear you hot to shoot at people. I am a criminal defense lawyer, not a criminal offense lawyer. There are other ways to handle the situation you describe. All I can say is don't act rashly without thinking it through. That is how most people get into trouble.

There is a guy who keeps coming to my apartment building and sitting in my front yard, and waits for my room mate to come out and see him. Normally this wouldnt be a problem, but the guy has been hostile towards me and has threatened me before, and so i, being the only one paying the rent and utility bills, told this guy not to come into my yard again. I dont know if castle laws will allow me to use force to remove him from my yard because i rent an apartment. I figured it didnt matter if my room mate invited him there or not because she doesnt pay any of the bills, i do, im just allowing her to stay there so she can be closer to her colege. So my question is, Could I, being the Head of the Household i geus you could say, use violent and or deadly force if this man comes into my yard again? He's been verbally warned twice not to come back, ive specifically told him that i will open fire on him should he come into my yard again. he doesnt live there, he has no right to be there. ive told my room mate if she wants to se hi, they can meet somewhere else. Am i in the clear to use force or not?

Thank you for the question. The answer is that your friend needs to retain an Mississippi criminal attorney that is familiar with Mississippi's castle law to help her. Castle doctine cases are almost always not going to be cut-and-dried, and are very case-specific, so it will be up to your friend's lawyer to present her case in the light most favorable to her, and to help her show the judge or the jury that the castle doctine should apply to the facts of her specific case.

if the castle law doctrine is allowed in the state of Mississippi, than why is it that someone i know has to go to court and is either going to be put on house arrest or is going to have to sever time. If she was at her house and the woman was on her property trying to get in the car where her daughter was. she was just trying to protect her daughter because she felt she was in danger. all she did was defend herself and her kid by hitting the women with her fist. than when the women got in the car and the womens sister tried to run her over.
